The terms “we”, “us” and “our” refer to VAASA Perfume. VAASA Perfume operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).
VAASA Perfume is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you access or use our Services.

Fragrance perception is subjective and may vary depending on factors including skin chemistry, environment, application and individual perception. Therefore, we cannot guarantee that a fragrance will smell or perform identically for every person.
Product descriptions and availability may be updated from time to time.
We reserve the right to discontinue products or limit quantities where reasonably necessary.
Nothing in this section affects any rights available to you where a product is defective, damaged, incorrect, materially different from its description, or otherwise subject to remedies under applicable law.
SECTION 3 — ORDERS
When you submit an order, you are making an offer to purchase the products included in that order.
An order is accepted after we confirm acceptance and, where applicable, successfully process the required payment.
We may refuse or cancel an order for legitimate reasons, including:

- Incorrect pricing or product information
- Delivery restrictions
- Suspected unauthorized resale

If we cancel a paid order, any applicable refund will be processed in accordance with our policies and applicable law.

If you need to cancel or change an order, contact us as soon as possible. Once an order has been processed or dispatched, cancellation or modification may no longer be possible.
Returns, refunds and exchanges are governed by our Return & Refund Policy.
Products purchased through our retail website are generally intended for personal or household use unless otherwise agreed with us.

Prices displayed on our Store are in Indian Rupees (INR).
Unless clearly stated otherwise, prices displayed for packaged products include applicable taxes where required by law.

You represent that you are authorized to use the payment method provided for your purchase.

We currently ship orders within India.
Shipping availability may depend on courier serviceability, destination and transportation restrictions applicable to fragrance products.
Delivery dates and timelines provided by us or our delivery partners are estimates and are not guaranteed unless expressly stated otherwise.
Delivery may be affected by circumstances including:
- Courier delays
- Destination serviceability
- Weather
- Public holidays
- Transportation disruptions
- Restrictions applicable to perfumes or alcohol-based fragrance products
- Events beyond our reasonable control
We will make reasonable efforts to assist customers experiencing delivery issues.
Customers are responsible for providing complete and accurate delivery information.

Nothing in these Terms limits any right or remedy available to consumers under applicable law.
SECTION 6 — INTELLECTUAL PROPERTY
The Services and their contents, including trademarks, trade names, logos, product names, designs, text, photography, graphics, videos, audio, layouts and other materials, are owned by or licensed to VAASA Perfume and are protected by applicable Indian and international intellectual property laws.
The Services are provided primarily for your personal, non-commercial use.
Except where permitted by law or with our prior written permission, you must not reproduce, copy, modify, distribute, republish, publicly display, transmit, commercially exploit or create derivative works from material belonging to VAASA Perfume.
Nothing contained in the Services grants you any ownership interest or licence in our intellectual property except where expressly stated.
The VAASA name, logos, designs, product names and other branding may not be used without appropriate authorization.
Shopify's names, trademarks, logos and related intellectual property belong to Shopify or its licensors.
Other trademarks displayed through the Services remain the property of their respective owners.

VAASA Perfume is powered by Shopify, which provides technology enabling us to operate our online Store.
Any purchase you make through our Store is made directly with VAASA Perfume.
Shopify is not the seller of VAASA products and is not responsible for fulfilling orders placed with VAASA Perfume.
The relationship between Shopify and VAASA Perfume, and Shopify's processing of applicable data, is governed by Shopify's applicable terms, policies and agreements.
Nothing in this section limits any rights you may have against VAASA Perfume under applicable law.
SECTION 10 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our Store is hosted by Shopify, Shopify may also collect and process certain information in connection with your access to and use of our Store.
Shopify's own processing of personal information may be governed by Shopify's privacy policies.

Sections which by their nature should continue after termination—including intellectual property, liability, privacy, governing law and outstanding payment obligations—will remain applicable.
Nothing in this section limits statutory consumer rights.

We make reasonable efforts to keep the Services accurate, secure and available.

This limitation does not apply where liability cannot legally be excluded or restricted.
Nothing in these Terms is intended to exclude, restrict or modify any right, remedy, statutory guarantee or liability available to a consumer under applicable consumer protection law.
SECTION 17 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold VAASA Perfume harmless against reasonable losses, liabilities or claims arising directly from:

- Your unlawful use of the Services; or

This section does not require you to indemnify us for losses caused by VAASA Perfume's own unlawful conduct, negligence or breach of obligations where such liability cannot lawfully be transferred to you.

The remaining provisions will continue to remain effective.

You may not transfer your rights or obligations under these Terms to another person without our consent where such transfer would materially affect our rights or obligations.
VAASA Perfume may transfer its rights and obligations as part of a lawful business restructuring, merger, acquisition, sale or similar transaction, provided that doing so does not unlawfully reduce your rights as a consumer.
Any assignment will remain subject to applicable law.

These Terms of Service and any separate agreements through which we provide the Services are governed by and construed in accordance with the laws of India.
Nothing in these Terms restricts any jurisdiction, remedy or consumer right available under applicable law.
Consumers may exercise rights and pursue remedies before the appropriate courts, Consumer Commissions or other competent authorities having jurisdiction under applicable Indian law.
Where possible, we encourage customers to contact VAASA Customer Support or our Grievance Officer first so that we can attempt to resolve concerns promptly.

The headings used in these Terms are provided for convenience and organization only.
They do not limit or otherwise affect the meaning or interpretation of these Terms.

We may update these Terms from time to time to reflect changes to:

- Regulatory requirements
The latest version will be made available through our website.
Where required by applicable law, we will provide appropriate notice of material changes.
Changes to these Terms will not retrospectively remove statutory rights or materially alter an already accepted order except where permitted or required by applicable law.
Your continued use of the Services following an effective update will constitute acceptance of the updated Terms where permitted by law.
